Part 1

Respond to the following in a minimum of 175 words:

Discussion Topic: Read “A Moratorium on the Presentation of DNA Evidence” from the University Library.

The author of this article stated that “this paper attempts to address wrongful convictions by calling for a temporary moratorium on the presentation of DNA evidence at trial, implemented until federal standards are put in place to regulate the presentation of DNA evidence…DNA analysis schemes are dangerously flawed…current problems in DNA testing procedures.” The author claims this is true by presenting several examples and arguments throughout this article.

This Daubert Standard requires that expert testimony regarding DNA evidence must be based upon a methodology that is scientifically valid and extremely reliable, peer reviewed, and universally accepted by the scientific community, and published in professional publications. The error rate and confidence levels for the DNA analysis methodology must also be known and stated.

Discussion Questions:

What is your analysis of this author’s demand for a temporary moratorium regarding DNA evidence after considering established court case law, Daubert v. Merrell Dow Pharmaceuticals, Inc., 509 U.S. 579 (1993), which was upheld by the United States Supreme Court?

Do you think that the author has scientific proof based upon peer-reviewed and accepted scientific methods that document his claims? Why or why not?
